These Terms of Service ("Terms") govern your use of FaxBackRx ("Service"). By creating an account, you agree to these Terms.

1. Service Description

FaxBackRx is a software service that enables licensed pharmacists at independent pharmacies to send clinical prescription clarification faxes to prescribers. The Service generates professionally formatted clinical PDFs and transmits them via SRFax.

2. Eligibility and Account Responsibilities

You must be a licensed pharmacist or authorized pharmacy staff member to use this Service. By registering, you represent that:

• You are authorized to send clinical communications on behalf of your pharmacy
• Your pharmacy is a HIPAA covered entity with appropriate policies in place
• All information you enter is accurate and used for legitimate clinical purposes
• You are responsible for maintaining the confidentiality of your account credentials

3. HIPAA Business Associate Acknowledgment

FaxBackRx acts as a Business Associate as defined under HIPAA when processing Protected Health Information on your behalf. By using the Service, you acknowledge:

• You are a Covered Entity under HIPAA responsible for complying with HIPAA regulations
• FaxBackRx implements reasonable safeguards for PHI as described in our Privacy Policy
• A formal Business Associate Agreement is available upon request at [email protected]
• You are responsible for using the Service in a HIPAA-compliant manner

4. Subscription Terms

• Trial: 14 days free, no credit card required. Full access to all features.
• Price: $99 per month per pharmacy account after trial
• Billing: Monthly, charged to the payment method on file via Stripe
• Cancellation: You may cancel at any time from your account settings. Access continues until end of current billing period.
• Refunds: No refunds for partial months. Contact support for billing disputes.

5. Acceptable Use

You agree to use FaxBackRx only for legitimate clinical prescription clarification purposes. You may not:

• Use the Service for any purpose that violates applicable laws or regulations
• Transmit unsolicited communications or spam via fax
• Attempt to circumvent security measures or access other accounts
• Use the Service to harass prescribers or for non-clinical communications

6. Clinical Disclaimer

FaxBackRx provides communication tools only. The Service does not provide medical or pharmaceutical advice. Clinical decisions remain entirely within the judgment of the pharmacist and prescriber. FaxBackRx's templates are communication aids, not clinical guidance.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAXBACKRX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 3 MONTHS PRECEDING THE CLAIM.

8. Service Availability

We target 99.5% uptime but do not guarantee uninterrupted service. Fax transmission depends on third-party services (SRFax). FaxBackRx is not liable for fax transmission failures caused by third-party services.

9. Termination

Either party may terminate the subscription at any time. We reserve the right to terminate accounts that violate these Terms. Upon termination, you may export your data. PHI may be retained as required by applicable law.

10. Governing Law

These Terms are governed by the laws of the United States. Disputes shall be resolved by binding arbitration under AAA rules.

11. Changes to Terms

We may update these Terms. Continued use of the Service after notice of changes constitutes acceptance.
